Thank you for choosing Smart Therapy! By accessing this website and using our services, you are agreeing to these terms. Please read the following carefully as it governs your use of the Web pages hosted by SmartTherapyGroup.net (referred to as "Smart Therapy", "we" or the "Site"). By accessing or using the Site, you expressly agree and consent to the following terms and conditions. If you do not accept the terms and conditions stated here, do not access or use the Smart Therapy sites.

ACCEPTANCE OF TERMS

By accessing or using our sites and services, you hereby agree to be bound by the terms and all terms incorporated herein by reference. The following Terms of Service Agreement ("TOS") is a legally binding agreement that shall govern your use of the Site including, but not limited to, all content such as text, information, images, forms and applications (collectively "Content") and  services ("Services") accessed through the Site and the relationship with our users and others which may interact or interface with Smart Therapy, LLC ("Smart Therapy") located at 9708 N Nevada St, Suite 205, Spokane, WA 99218 in association with the use of the Site.

USE

The Content within the Site includes original and copyrighted works proprietary to Smart Therapy or to third parties who have provided us with Content ("Content Providers"). You may download and print a single copy of the Content solely for your internal non-commercial use, provided that such Content must not be altered in any way and must contain all copyright and proprietary rights notices that accompany such Content. ANY UNAUTHORIZED OR UNAPPROVED USE OF ANY OF THE CONTENT CONSTITUTES COPYRIGHT INFRINGEMENT AND SUBJECTS YOU TO ALL CIVIL AND CRIMINAL PENALTIES PROVIDED FOR UNDER DOMESTIC AND INTERNATIONAL COPYRIGHT, TRADEMARK, AND OTHER LAWS AND TREATIES.

RSS feeds of content headlines, limited text and a source link ("RSS Content") may be accessed through the Site. You must use the RSS feeds as provided bySmart Therapy, and you may not edit or modify the text, content or links supplied by Smart Therapy which link to reader to access the original full length article on SmartTherapyGroup.net (“Source Content”). The RSS Content may only be used with platforms that display a functional link that when accessed, takes the viewer directly to the Source Content on SmartTherapyGroup.net. You may not use RSS Content in a way that does not directly link to the Source Content on SmartTherapyGroup.net, including the use of redirect links, intermediate pages, splash pages, or other means that is not directly linking to the original Source Content on the Site.

INTELLECTUAL PROPERTY

You agree that we (or our Content Providers) own all rights, titles and interests in and to the Site and all intellectual property rights therein. No other rights or licenses, whether express, implied, arising by estoppel, or otherwise are conveyed or intended by this Agreement.

The Site may contain advertisements and other types of links to third-party websites. These third-party websites are not under the control of Smart Therapy and we are not responsible for the content, products or services they provide. Your use of linked third-party websites is at your own risk. Smart Therapy does not endorse any third-party websites.

LIMITATION OF LIABILITY

You explicitly acknowledge, understand and agree that under no circumstances shall Smart Therapy be responsible or liable to you, or any other entity for any punitive, direct, indirect,  incidental, consequential, compensatory, special or exemplary damages including, but not limited to, damages that may be related to the loss of any profits, data, use, goodwill  and/or other intangible losses that result from or relate in any manner to a) use of, or inability to use or access, the Site, b) reliance on the Content of the Site, c) errors, defects or inaccuracies in our Content or our Content Providers,  d) unauthorized access to or alteration of your transmissions or data, e) statements or conduct of any third- party and f) any other matter which may be related to our Site and service. The foregoing exclusion shall apply regardless of whether the possibility of such damages was advised. Some jurisdictions do not permit the exclusion of certain types of damages. Therefore, only if required by applicable law, some or all of the exclusions above may not apply to you.

NOTICE

Smart Therapy reserves the right to modify or change the TOS at any time. Should such changes be made, Smart Therapy will notify users through the Site.

INDEMNITY

You agree to defend, indemnify and hold us harmless against any losses, expenses, costs or damages arising from or in any manner related to a) your violation of the TOS, b) your unauthorized or unlawful use of the Site and/or Content and c) unauthorized or unlawful use of the Site and/or Content by anyone claiming to be you.

PRIVACY

Your use of the Site is subject to the terms and conditions of our Privacy Policy. Please read it carefully.

GOVERNING LAW

It is at the mutual agreement of both you and Smart Therapy with regard to the TOS that the relationship between the parties shall be governed by the laws of the state of Washington without regard to its conflict of law provisions and that any and all claims, causes of action and/or disputes, arising out of or relating to the TOS, or the relationship between you and Smart Therapy, shall be filed within the courts having jurisdiction with the County of Spokane, Washington or the U.S. District Court located in Washington State. You and Smart Therapy agree to submit to the jurisdiction of the courts as previously mentioned, and agree to waive any and all objections to the exercise of jurisdiction over the parties by such courts and to venue in such courts.

ENTIRE AGREEMENT

This TOS, including the Privacy Policy, contains the entire agreement between you and Smart Therapy and shall govern the use of the Site and Services, superseding an prior version of this TOS. You may be subject to other terms and conditions that may apply when you use or purchase other Smart Therapy services, affiliate services and/or third-party content or services.
